Terms of use for end users accessing the ShoWhere online platform

These terms of use apply to any user of the ShoWhere online platform, which hosts the indicators generated by ShoWhere: https://platform.showhere.fr.

A user (hereinafter the “user”) is any natural person accessing one of the procedures offered by the ShoWhere platform and holding an access account created by ShoWhere.

Indicators (hereinafter the “indicators”) are the local data made available to the user on the ShoWhere platform.

Definition and purpose of the online service

The ShoWhere online platform is a secure platform that the user accesses with a login and a password. This platform allows the user to:

• view target indicators at different levels of resolution,
• create, manage and obtain aggregated results on their areas of interest, such as catchment areas, commercial prospecting areas, distribution areas, etc.,
• cross-reference target indicators with other indicators, such as profiles, media, etc., over an entire country or over their areas of interest,
• export indicators and results to integrate them into their working environment, such as Excel, geographic information systems (GIS), media planning tools, etc.

Use of the online service (hereinafter the “platform”)

Use of the platform is reserved for users authorised by ShoWhere. Each user must log in with their personal credentials and is responsible for the confidentiality of their login and password.

Maintenance

The platform may undergo periodic maintenance operations aimed at improving performance and adding new features. During these maintenance periods, ShoWhere strives to keep the platform functional. However, the user is asked to report any malfunction so that ShoWhere can remedy it as soon as possible.

Definition of the indicators

ShoWhere indicators are generated by cross geostatistical processing of:

• responses to consumer surveys carried out on a nationally representative basis (sex, age, social class, region) and on large panels,
• open-source census socio-demographic data.

The indicators never constitute personal data. They result from modelling and/or reflect average estimates over a geographical area.

Ownership of the indicators

The indicators made available on the online platform are the property of ShoWhere. They are intended for internal use within the user’s company, unless otherwise provided in a contract signed between ShoWhere and the user.

Protection of intellectual property

In the context of the use of the ShoWhere platform and associated services, ShoWhere stresses the importance of protecting intellectual property, including the technologies, methodologies, modelled data, know-how and any other sensitive business information developed and used by ShoWhere.

Intellectual property rights

All intellectual property rights relating to the ShoWhere platform, including:

• Software: all computer programs, applications, scripts and other software elements developed or used by ShoWhere to provide its services.
• Databases: the structured collections of data organised so as to allow their electronic processing, which may be protected by database rights or other intellectual property laws.
• Modelling methodologies: the techniques, methods, algorithms and procedures used by ShoWhere to generate, process, analyse or interpret data and indicators.
• Generated content: any content, such as reports, analyses, visualisations, charts, maps, texts, images, videos or other elements created or generated by ShoWhere as part of its services.

are and remain the exclusive property of ShoWhere. Use of the ShoWhere platform by users grants them no right over ShoWhere’s intellectual property resources, unless such rights are explicitly granted by these Terms of Use or upon specific request to ShoWhere.

Confidentiality and non-disclosure

Users undertake to keep confidential all information relating to the methodologies, technologies and modelled data that they may learn of while using the platform. Disclosing to third parties any information considered proprietary or confidential without ShoWhere’s prior written consent is prohibited. This confidentiality undertaking survives the user’s use of the platform.

Authorised use

Users’ use of the Intellectual Property Resources is strictly limited to the purposes authorised by these Terms of Use. Any use beyond these purposes, including the modification, reproduction, distribution or creation of derivative works based on ShoWhere’s Intellectual Property Resources, without ShoWhere’s prior written authorisation, is expressly prohibited.

Measures in the event of a breach

ShoWhere reserves the right to take all necessary measures, including legal action, to protect its intellectual property rights and to address any breach of the confidentiality and non-disclosure undertakings set out in these Terms of Use.

Liability

ShoWhere cannot be held liable for damage caused by incorrect or unauthorised use of the data or of the online service. We reserve the right to suspend or terminate access to the online service in the event of a breach of these terms of use.

Collection and use of activity data

When you use the ShoWhere platform, certain data relating to your activities may be collected and recorded. These data are used solely for the following purposes:

• ensuring the security of the platform and of your data;
• preventing and detecting unauthorised or abusive activities;
• improving the operation and performance of our services.

Data collected

The data collected may include:

• information about the actions performed (e.g. pages viewed, types of requests, unauthorised access attempts);
• technical information (e.g. IP addresses, session identifiers).

Legal basis

The collection of these data is based on:

• our legitimate interest in ensuring the security and quality of the services;
• our legal obligation to protect your data and that of our partners.

Confidentiality of the data collected

The data collected will never be used for commercial purposes or shared with third parties, except where required by law (e.g. a court order).

Use of Showy

Showy is an artificial intelligence agent built into the ShoWhere platform. It helps in particular with searching, analysing and interpreting the data made available by ShoWhere.

The responses produced by Showy are generated automatically from the data and information the agent has access to. Despite the measures taken to ensure their quality and relevance, they may contain approximations, errors or incomplete interpretations. They are an aid to analysis and decision-making and cannot replace the user’s own judgement.

The user remains responsible for the use they make of the results provided by Showy and undertakes not to use the service to access data they are not authorised to access, to circumvent the limitations of the platform, or to submit personal, confidential or sensitive data that is not necessary for its use.

The use of Showy confers no ownership right over the data, indicators, models, methodologies or content made available by ShoWhere. The rights applicable to these elements remain those defined in these Terms of Use.

Requests sent to Showy and the responses generated may be recorded and processed by ShoWhere for the purposes of operating, supporting, securing and improving the service. How these data are processed and retained is set out in the Privacy Policy.

ShoWhere may change the artificial intelligence models, technologies, data sources and features used by Showy in order to improve or develop the service, without this constituting a substantial modification of these Terms of Use.

Your rights

In accordance with the General Data Protection Regulation (GDPR), you have the following rights regarding your data:

• access to, rectification or erasure of your personal data;
• objection to or restriction of processing;

Changes to the terms of use

We reserve the right to modify or update these terms of use without notice. By accepting these terms of use, you acknowledge that you have read, understood and accepted the terms and conditions set out. In the event of non-compliance with these terms, we reserve the right to take appropriate action, including termination of access to the online service.
